Chai Builder provides tools for building and hosting websites, including drag-and-drop editors, templates, domain integration, and storage via partners like Supabase and Vercel. We grant you a limited, non-exclusive, non-transferable license to use our services for personal or business purposes, subject to these Terms.
You agree not to use the services for illegal activities, to infringe on others' rights, or to distribute harmful content such as malware or spam. We reserve the right to suspend or terminate your access if you violate these Terms.
You retain ownership of any content you upload or create using our platform, such as text, images, designs, and code ("User Content"). By uploading User Content, you grant us a worldwide, royalty-free license to host, store, and display it as necessary to provide our services.
Chai Builder owns all intellectual property rights in our platform, including templates, software, and branding. You may not copy, modify, or reverse-engineer our services without our written permission.
Certain features require payment. Subscription plans are billed in advance on a monthly or annual basis, as selected during signup. All fees are non-refundable except as required by law or specified in our refund policy.
We use third-party payment processors and do not store your full payment details. You authorize us to charge your provided payment method for all applicable fees, including taxes. If payment fails, we may suspend your account until resolved.
Prices may change with notice. You can cancel your subscription at any time, but no refunds will be issued for partial periods.
If you use our hosting or domain integration features, you agree to comply with applicable laws and our acceptable use policy. We do not guarantee uninterrupted service and may perform maintenance that affects availability.
You are responsible for your website's content and any disputes arising from it. We are not liable for data loss; we recommend regular backups.
To the fullest extent permitted by law, Chai Builder and its affiliates shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the services, including loss of profits, data, or business opportunities.
Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim. These limitations apply even if we have been advised of the possibility of such damages.
You agree to indemnify and hold harmless Chai Builder, its officers, employees, and partners from any claims, losses, or damages arising from your use of the services, your User Content, or your violation of these Terms or applicable laws.
We may terminate or suspend your account at any time for any reason, including violation of these Terms. Upon termination, your license to use the services ends, and we may delete your data after a reasonable period.
You may terminate your account by contacting us. Outstanding fees remain payable.
Any disputes arising from these Terms shall be governed by the laws of India, without regard to conflict of law principles. You agree to resolve disputes through binding arbitration in Pune, Maharashtra, before a single arbitrator, rather than in court, except for small claims.
If arbitration is not applicable, exclusive jurisdiction lies with the courts in Pune, Maharashtra.
These Terms constitute the entire agreement between you and Chai Builder. If any provision is found invalid, the remaining provisions remain in effect.
We may assign these Terms without your consent in the event of a merger or acquisition. You may not assign them without our written approval.
Force majeure events, such as natural disasters or pandemics, excuse non-performance.
